Types of Trademark License
- Product / Goods Symbol Trademark:- The brand term. or the symbol, or the emblem is attached to the commodity to make it distinct from the others, is considered a product trademark.
- Service Trademark:- The brands utilized by the business company, such as the television service, distribution store, consultancy, IT outsourcing firm, etc., are considered brands that are intended to distinguish the companies.
- Collective Trademark:-Trademarks licensed on behalf of individuals, societies or other organisations for the benefit of representatives of the party in their promotional operations shall be considered joint trademarks.
Validity of the Trademark License?
The registered trademark is valid for 10 years from date of filing.The trademark owner can file for renewal of the registration to keep the registered trademark updated, only prior to the end of the validity.
Documents List for Trademark License Registration
Following are the documents required for trade license:
- PAN Card, Aadhaar Card, Certificate of Incorporation/Registration (Other than Individual applicant)
- Brand Name & Logo– Symbol/Logo of the Trademark to be registered
- Khata Certificate
- Occupancy Certificate
- NOC from neighbours
- Building plan of the trade premises
- Property Tax Paid Receipt
- Rent agreement (in case premises are rented)
- Power of Authorization, a legal document that allows the attorney to file the trademark registration on your behalf.
- In case of a Start-up or MSME, certificate of registration, to enjoy 50% rebate on government fee
- User affidavit along with proof of TM Use:-In case you want to register the trademark from a specific date, then you need to submit an affidavit alongwith documentary proof such as invoices, registration certificates etc
